Purpose

The Diocesan Tribunal administers justice for the faithful of the Catholic Church in the Diocese of Colorado Springs. It ensures that the Diocese is in conformance with Canon Law, it adjudicates Church legal matters as needed, and the officials of the Tribunal guide individuals through the legal processes of the Church when they need assistance.

For example, the Diocesan Tribunal is responsible for processing marriage cases where petitions for declaration of nullity (often referred to as annulment) have been submitted. It is also responsible for processing privilege cases as well (Pauline and Petrine).

Nullity Cases

Lack of Form Case

A “Lack of Form” case can be pursued if one or both parties to a marriage had been baptized in the Catholic Church before their marriage AND the marriage ceremony was not Catholic. To pursue this type of case, at least one Catholic party to the marriage must not have formally left the Church. Also, the marriage must not have been permitted through a dispensation from the Bishop (or his designated authority).

Ligamen Case

A “Ligamen” case can be pursued if either party to a marriage had been married previously without obtaining a declaration of nullity for the previous marriage.
